Moving to a Competitor

If you are moving jobs to a competitor or even starting your own business in the same field your contract of employment may contain restrictions which seek to prevent you being in competition or contacting customers for a period of time. In addition you owe a duty of loyalty while being employed by a firm which severely restricts certain competitive activities while you are employed and a duty of confidentiality which will survive the termination of your employment.

We are specialist employment solicitors and have extensive experience of restrictive covenants, team moves, confidentiality obligations and injunctive proceedings.

We understand the law in this area and can advise you upon

  • the enforceability of any restrictions in your contract of employment
  • what actions you can take and what you cannot do
  • the effect of any breach of your contract
  • resisting any attempt by your employer to injunct you or claim damages

Restrictive covenant issues are almost always urgent and we are well known for our ability to act quickly and decisively on your behalf.

Recently we have acted for the employee of a well known national franchise operator and successfully resisted an action against her. We acted for a Director of an international services business who set up in competition with one of their divisions and steered her through her contractual minefield to a successful start up business.
